Terms of Service

1. Acceptance of terms

By accessing or using the HopeNow platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform. HopeNow ("we", "us", "our") reserves the right to update these Terms at any time. Continued use after changes constitutes acceptance.

2. About the Platform

HopeNow is a marketplace that connects individuals ("Clients") with qualified wellness and mental health practitioners ("Practitioners"). We provide the technology and tools to facilitate discovery, booking, communication, and payment. We are not a healthcare provider and do not provide medical advice, diagnosis, or treatment.

3. Eligibility

  • You must be at least 18 years old to create an account.
  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • Practitioners must hold valid, current credentials and licences for the services they offer on the Platform.

4. Account responsibilities

You are responsible for all activity under your account. You agree to notify us immediately of any unauthorised access. We may suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or harmful behaviour.

5. Bookings and sessions

5.1 Booking

When you book a session through the Platform, you enter into a direct arrangement with the Practitioner. HopeNow facilitates the booking but is not a party to the practitioner-client relationship.

5.2 Cancellation and rescheduling

Cancellation and rescheduling policies are set by individual Practitioners and displayed at the time of booking. Please review these policies before confirming your booking.

5.3 No-shows

If you miss a scheduled session without cancelling in advance, the Practitioner's no-show policy applies. Refunds for no-shows are at the discretion of the Practitioner.

6. Payments

  • All fees are displayed before you confirm a booking. Prices are in Indian Rupees (INR) unless otherwise stated.
  • Payments are processed through our secure third-party payment provider. We do not store your full payment card details.
  • Refunds are subject to the applicable cancellation policy and are processed within 5–10 business days.
  • Practitioners receive payouts according to the agreed commission structure and payout schedule.

7. Practitioner obligations

Practitioners using the Platform agree to:

  • Maintain valid professional credentials and licences.
  • Provide services within their scope of practice.
  • Keep their availability and profile information accurate and up to date.
  • Comply with all applicable laws, regulations, and professional standards.
  • Maintain appropriate professional liability insurance.

8. Client obligations

Clients using the Platform agree to:

  • Provide accurate information in intake forms and communications.
  • Treat Practitioners and other users with respect.
  • Honour booking commitments and cancellation policies.
  • Understand that the Platform is not a substitute for emergency medical services. In a crisis, please contact emergency services or visit our crisis support page.

9. Content and conduct

  • You retain ownership of content you submit (reviews, messages, profile information).
  • By posting content, you grant HopeNow a non-exclusive licence to display it on the Platform.
  • You may not post content that is false, defamatory, harassing, discriminatory, or otherwise harmful.
  • We reserve the right to remove content that violates these Terms.

10. Intellectual property

The Platform, including its design, text, graphics, logos, and software, is owned by HopeNow and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our written permission.

11. Limitation of liability

To the maximum extent permitted by law, HopeNow is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. This includes, but is not limited to, the quality of services provided by Practitioners, any health outcomes, or any loss of data.

HopeNow does not guarantee the qualifications, competence, or quality of any Practitioner listed on the Platform. Clients are encouraged to verify Practitioner credentials independently.

12. Disclaimer

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

13. Dispute resolution

Any disputes arising from these Terms or your use of the Platform shall be governed by the laws of India. You agree to first attempt resolution through our support team before pursuing formal proceedings. Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, India.

14. Termination

You may close your account at any time through your account settings. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Platform ceases immediately, though certain provisions (liability, intellectual property, dispute resolution) survive.
